Terms and Conditions


BUYER REGISTRATION

Each potential bidder must register with Genes Diffusion @ www.genesdiff-usa.com to obtain a bidding number. Required information includes: contact person's name, farm/purchaser name, address, telephone/fax number(s), and email address. Each bidder will be assigned a unique bidding number that will be used to establish or advance their bid. Any questions concerning registering as a bidder or concerning the cattle for auction should be directed to Steve Keller at 800-362-4647.

BIDS

Bidding will open at 9:00 a.m. (C.S.T.) on August 21, 2001 and close at 4:00 p.m. (C.S.T.) on August 23, 2001. A minimum bidding price/head will be listed on each lot. Bids will be accepted in $25.00 increments and posted on the website as soon as they are confirmed. At the close of the auction, Genes Diffusion will contact the successful buyer to complete details of the purchase. Genes Diffusion will also contact the contending bidder. In the event the original buyer cannot complete the terms of the purchase, the contending bidder will become the buyer at the contending bid price.

PAYMENT

Each successful buyer will have a 48-hour grace period to make settlement via electronic banking. No animals will be released for transport until satisfactory settlement has been made. If the proper arrangements have not been completed with the 48-hour period, the contending bidder will then become the buyer. All settlements are to be made in US currency only.

RISK

All animals are at the purchaser's risk upon completion of the sale. Genes Diffusion will care for the animals at no extra charge to the buyer for up to 7 days from purchase. Alternative arrangements must be approved with Genes Diffusion prior to auction by contacting Steve Keller at 800-362-4647.

WARRANTIES

Each consignor warrants clear title to the animal and the right to sell same. Each animal is sound and healthy in every aspect. All animals will be inspected and sleeved by an independent and accredited veterinarian previous to the sale. No animal will be included for sale without a clean bill of health by said veterinarian. Each lot will have a health record indicating vaccination status and product name, blood testing results and all other pertinent information. The seller has represented the breeding record of each animal as accurately as possible. No animal is guaranteed to be free from hardware, nor is the condition of any udder upon calving.

TRANSPORTATION

Transportation can be coordinated by the seller. Only professional and licensed haulers with proven track records and proper insurance coverage will be used. All costs, risks, and responsibilities will be borne by the purchaser. The seller assumes no liability as to the condition of the animals upon delivery.

CERTIFICATES OF OWNERSHIP/IDENTIFICATION

Registration certificates and completed transfers will be provided to the purchaser upon final settlement. Costs related to the transfer of ownership will be the responsibility of the purchaser.

ERRORS

The material in the catalog has been carefully edited. All production and classification data is current. Any omissions or errors in the catalog discovered during the course of the auction will be disclosed. The seller and sale management are not responsible for any detected errors.

HEALTH WARRANTY

The results of any future health tests are not guaranteed. The seller and sale management hereby notify buyers that according to the Wisconsin Department of Agriculture, Trade and Consumer Protection Regulation 12:21 - "All animals are sold as originating from a maximum risk Paratuberculosis herd." The seller and sale management cannot be held liable.


Genes Diffusion and Mike Holschbach Sales assume no responsibility or liability, but will endeavor to protect the interests of both buyer and seller.
